Terms & Conditions

These Terms & Conditions govern the use of the Hilmuks Safaris & Adventures website and all services provided by the company. By accessing our website, submitting an enquiry, or confirming a booking with us, you confirm that you have read, understood, and agreed to be bound by these Terms & Conditions.

They are intended to provide transparency, protect both parties, and set clear expectations throughout the booking and travel process.

1. Booking & Payment

A safari or tour booking is considered confirmed only after receipt of a deposit or full payment, as agreed in writing between the client and Hilmuks Safaris & Adventures.

  • Prices are quoted primarily in United States Dollars (USD) unless otherwise stated.
  • Prices may be subject to change due to factors beyond our control, including but not limited to currency fluctuations, government taxes, park fee revisions, or supplier cost increases.
  • Full payment is generally required prior to the commencement of travel unless alternative written arrangements have been agreed upon.
  • Failure to complete payment within agreed timelines may result in automatic cancellation of the booking.

2. Travel Documents & Insurance

Clients are fully responsible for ensuring that all required travel documents are obtained before travel, including:

  • Valid passports and visas
  • Required vaccination certificates and health documentation
  • Any additional entry or transit requirements for destination or transit countries

Hilmuks Safaris & Adventures strongly recommends that all clients obtain comprehensive travel insurance covering medical expenses, emergency evacuation, trip cancellation or interruption, travel delays, and loss or damage of personal belongings. We shall not be liable for losses that could reasonably have been covered by travel insurance.

3. Health & Safety

Clients must disclose any relevant medical conditions, dietary requirements, physical limitations, or special needs at the time of booking to enable appropriate planning and risk management.

By participating in safari and adventure activities—including but not limited to game drives, walking safaris, trekking, balloon safaris, and cultural tours—clients acknowledge that such activities involve inherent risks and agree to:

  • Participate at their own risk
  • Follow all instructions provided by guides, rangers, pilots, and service providers
  • Accept that non-compliance with safety instructions may result in exclusion from certain activities without refund

4. Changes & Cancellations

Any request to modify a confirmed booking must be made in writing and is subject to availability, supplier conditions, and potential additional costs.

  • Cancellation terms, refunds, and penalties are governed by our Refund & Cancellation Policy, which may vary depending on timing and third-party supplier rules.
  • Where Hilmuks Safaris & Adventures is required to cancel or significantly alter a booking due to unforeseen circumstances, we will make reasonable efforts to offer suitable alternatives of comparable value or process refunds in accordance with applicable policies.

5. Third-Party Providers

Hilmuks Safaris & Adventures works with independent third-party service providers, including:

  • Safari lodges and hotels
  • Airlines and charter flight operators
  • Ground transport providers
  • Professional guides and specialist activity operators

These providers operate independently. While we carefully select reputable partners, Hilmuks Safaris & Adventures cannot be held responsible for their acts, omissions, performance, or operational decisions. We will, however, offer reasonable assistance to help resolve issues where possible.

6. Limitation of Liability

Hilmuks Safaris & Adventures, its owners, employees, agents, and affiliates shall not be liable for any injury, loss, damage, delay, cost, or inconvenience arising directly or indirectly from circumstances beyond our reasonable control, including but not limited to:

  • Acts of wildlife or natural environmental conditions
  • Adverse weather conditions
  • Government actions, travel restrictions, or park closures
  • Airline delays, cancellations, or schedule changes
  • Accidents, illness, injury, or death during travel

Our obligation is limited to acting in good faith and providing reasonable assistance to minimize disruption where practicable.

7. Force Majeure

Hilmuks Safaris & Adventures shall not be deemed in breach of these Terms & Conditions or held liable for failure or delay in the performance of services caused by events beyond our reasonable control (“Force Majeure Events”).

Force Majeure Events include, but are not limited to:

  • Natural disasters, extreme weather, floods, droughts, earthquakes, or wildfires
  • Acts of wildlife, environmental hazards, or park access restrictions
  • Epidemics, pandemics, or public health emergencies
  • Government actions, border closures, travel advisories, or regulatory changes
  • War, terrorism, civil unrest, political instability, or labor strikes
  • Mechanical or operational failures of transport providers

In such circumstances, Hilmuks Safaris & Adventures will use reasonable efforts to notify affected clients promptly and, where feasible, offer alternative arrangements of comparable value or rescheduling options.

Any refunds or credits will be subject to funds recoverable from third-party suppliers and their applicable policies.

8. Intellectual Property

All content on the Hilmuks Safaris & Adventures website—including text, images, videos, logos, branding, and design elements—is the intellectual property of Hilmuks Safaris & Adventures unless otherwise stated.

No content may be copied, reproduced, distributed, or used for commercial purposes without prior written consent.

9. Website Use

Website content is provided for general information and booking purposes only. Users agree not to misuse the website, interfere with its operation, or reproduce content without authorization.

Hilmuks Safaris & Adventures reserves the right to restrict or terminate access to the website if misuse or unauthorized activity is detected.

10. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Kenya, where Hilmuks Safaris & Adventures operates as a registered business.

Any disputes arising from these Terms & Conditions or the services provided shall be subject to the exclusive jurisdiction of the courts of Kenya.
